What probate is and why it matters when you sell

Probate is the legal process that gives someone the authority to deal with a person’s estate after they die. The estate is everything they owned, including money, belongings and property. Until that authority is in place, nobody can legally sell a house that was in the deceased person’s sole name.

If you’ve inherited a house, or you’ve been named as an executor, this can feel like a lot to take on while you’re grieving. It helps to know the main steps before you start. Then you can take things one stage at a time, rather than trying to deal with everything at once.

You won’t always need probate. A home owned as “joint tenants”, for example, usually passes straight to the surviving owner. But where the house was in one name, or owned as “tenants in common”, the buyer’s conveyancer will normally want to see the official grant before the sale can go through.

Grant of probate or letters of administration?

In England and Wales, the document that gives someone the legal right to deal with an estate is called a grant of representation. There are two main types, and which one you need depends on whether there’s a valid will.

• A grant of probate goes to the executors named in a valid will.
• Letters of administration are issued when there’s no will, or when the will doesn’t name an executor who is able or willing to act. The person appointed is called an administrator, and under the rules of intestacy it’s usually a close relative.

When it comes to selling a probate property, both do the same practical job. They show the buyer, the solicitors and HM Land Registry that you have the authority to sign the sale paperwork. The GOV.UK page on applying for probate explains how to apply and what you’ll need.

Who has the authority to sell an inherited property

While the estate is being dealt with, only the executors or administrators (known together as “personal representatives”) can sell an inherited property. Beneficiaries who aren’t also executors don’t have that power, even if the money from the sale will eventually come to them.

If there’s more than one executor, you’ll usually need to act together. That means agreeing the sale price, the buyer and the timing, and all of you signing the documents. Decide early on who will be the main contact for estate agents, buyers and solicitors.

Executors have to act in the best interests of the estate as a whole. Day to day, that means getting a fair idea of what the house is worth, weighing up the options sensibly, and keeping a written note of the decisions you make and why you made them.

The probate timeline and when you can sell

There’s no fixed timetable. How long probate takes depends on how complicated the estate is, whether inheritance tax is due, and how busy the probate service is when you apply. For many families it takes several months from the date of death to getting the grant, and sorting out the whole estate can take longer.

Marketing before the grant

You don’t have to wait for the grant before putting the house on the market. Plenty of executors get valuations, talk to agents or ask for offers while the application is being processed. That can save time, because a buyer can be lined up and the conveyancing started.

Exchanging and completing after the grant

What you can’t do is complete the sale until the grant has been issued. Most solicitors will also advise against exchanging contracts before then, because nobody can be sure when it will arrive. Be upfront with any buyer about where you are in the probate process, so both sides have realistic expectations.

Valuing the property and inheritance tax

As part of the probate application, the estate has to be valued. The house is valued at its open market value on the date of death, not the date you sell. This figure is often called the probate value. It matters now for inheritance tax, and later on for capital gains tax.

Getting a date-of-death valuation

Estate agents will often give a free market appraisal, which is a useful starting point. For a larger estate, or where tax may be payable, a formal valuation from a qualified surveyor is usually the safer choice. HMRC can question a figure that looks too low or too high, so you want a value you can justify.

Inheritance tax basics

Inheritance tax may be due if the estate is worth more than the tax-free threshold, after any reliefs and exemptions. Thresholds and allowances change, and some depend on who inherits the home, so always check the current rules on the GOV.UK inheritance tax pages.

Many families don’t expect this part. Where inheritance tax is owed, at least some of it usually has to be paid before the grant of probate is issued. That can feel like a catch, because the main asset is often the house you can’t sell yet. Options can include paying from the deceased’s bank accounts, paying the tax on property in instalments in some cases, or borrowing. A probate solicitor or accountant can tell you what applies to you.

Looking after an empty property

An inherited property often sits empty for weeks or months while probate is sorted out. Empty homes bring their own risks and costs, so make a simple plan early on.

Insurance

Tell the home insurer about the death as soon as you can. Many standard policies limit or remove cover once a property has been unoccupied for a set period. You may need specialist unoccupied property insurance, and the insurer may ask for regular inspections as a condition of cover.

Council tax

Let the local council know about the death. An empty home is often exempt from council tax while you wait for the grant, and sometimes for a while afterwards if it’s still unsold. Once any exemption ends, some councils charge a premium on homes left empty for a long time, so check the rules with the council for the area.

Security and utilities

• Check the doors and windows lock properly, and think about changing the locks if you’re not sure who has keys.
• Take out valuables, important papers and anything with sentimental value.
• Take meter readings and tell the gas, electricity and water suppliers about the death.
• In colder months, keep some low background heating on, or ask a plumber about draining down the system, to lower the risk of burst pipes.
• Redirect the post, and visit regularly or ask a neighbour you trust to keep an eye on the house.

Clearing the house

For a lot of people, clearing a loved one’s home is the hardest part. Before anything goes, check the will for specific gifts and make sure all the executors agree. Keep documents such as deeds, bank statements, bills and pension letters, as you may need them for probate. Things nobody wants can be shared among family, given to charity, sold, or taken away by a house clearance company. Ask any buyer what they need cleared before completion, too. Some will take a property with the contents left behind.

Choosing how to sell a probate property

There are three main ways to sell a probate property, and none of them suits everyone. The right one depends on the condition of the house, how quickly the estate needs the money, how many people have to agree, and how much uncertainty you’re comfortable with.

Selling through an estate agent

If the house is in reasonable condition and you’re not pushed for time, the open market often gives the highest price. Bear in mind the estate keeps paying insurance, utilities and possibly council tax while the house is on the market. A sale that falls through late on can add months.

Selling at auction

Auctions can work well for homes that need modernising. At a traditional auction, the buyer is usually committed once the hammer falls. The downside is that you can’t know the final price in advance, and there are fees to budget for.

When several people inherit

When an inherited property is left to more than one person, everyone will have a view on what should happen. One of you may want to sell house fast and release the money, another may want to keep it, and someone else may hope to buy the others out. Those conversations go more smoothly when everyone is working from the same information.

• Share valuations and any offers with all the beneficiaries.
• Agree in writing how the sale money and the costs will be split.

Capital gains tax on a rise in value

If the executors sell while the estate is being administered, the estate is usually responsible. If the property passes to the beneficiaries first and they sell it, the tax position is theirs.

A practical checklist for selling a probate property

Every estate is different, but most executors work through these steps when they sell an inherited property.

1. Register the death and get several copies of the death certificate.
2. Find the will, if there is one, and confirm who the executors are.
3. Check how the house was owned and whether there’s a mortgage or equity release loan to pay off.
4. Tell the insurer, the council, the utility suppliers and any lender about the death.
5. Secure the house, take out valuables and arrange regular checks.
6. Get a date-of-death valuation of the property.
7. Value the rest of the estate and work out whether inheritance tax is due.
8. Pay any inheritance tax that’s needed before applying, then apply for the grant of probate or letters of administration.
9. Agree how to sell with the other executors, and keep the beneficiaries in the loop.
10. Clear the house, setting aside important documents and agreed gifts.
11. Market the property or ask for offers while the probate application is processed.
12. Instruct a conveyancer, then exchange and complete once the grant has been issued.
13. Check for any capital gains tax, settle the estate’s debts and share out the proceeds.
